1. Acceptance of Terms
By downloading, installing, or using the Habitrive app ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.
2. Use of the App
Habitrive is a personal habit and goal tracking application. You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the App in any way that violates applicable local, national, or international laws
- Attempt to gain unauthorized access to any portion of the App or its related systems
- Transmit any unsolicited or unauthorized advertising or promotional material
- Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the App
3. User Accounts
To use certain features of the App, you may need to create an account. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Providing accurate and complete information when registering
You must be at least 13 years old to create an account. By creating an account, you confirm that you meet this requirement.
4. Pro Subscription
Habitrive offers a Pro subscription that unlocks additional features including AI coaching, weekly reports, and habit challenges. The following terms apply to Pro subscriptions:
- Billing: Subscriptions are billed on a recurring basis (monthly or annually) through the Apple App Store. Payment is charged to your Apple ID account at confirmation of purchase.
- Auto-Renewal: Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period.
- Cancellation: You can manage and cancel your subscription in your App Store account settings. Cancellation takes effect at the end of the current billing period.
- Refunds: Refund requests are handled by Apple in accordance with their refund policy. We do not issue refunds directly.
- Price Changes: We reserve the right to modify subscription prices with reasonable advance notice.
5. Intellectual Property
The App and its original content, features, and functionality are owned by Habitrive and are protected by international copyright, trademark, and other intellectual property laws.
You retain ownership of the content you create within the App (habits, goals, notes). By using the App, you grant us a limited license to store and process this content solely to provide the service to you.
6. AI Features
Habitrive uses AI-powered features (Pro plan) to provide personalized coaching and weekly reports. Please note:
- AI-generated content is for informational and motivational purposes only
- AI responses are not a substitute for professional medical, psychological, or health advice
- The accuracy and relevance of AI-generated content may vary
7. Disclaimer of Warranties
The App is provided "as is" and "as available" without any warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
8. Limitation of Liability
To the maximum extent permitted by law, Habitrive shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, even if we have been advised of the possibility of such damages.
9. Termination
We reserve the right to suspend or terminate your account at our discretion if you violate these Terms of Service. You may delete your account at any time from the Profile settings in the App.
10. Changes to Terms
We may update these Terms of Service from time to time. We will notify you of significant changes by updating the date at the top of this page. Your continued use of the App after changes constitutes acceptance of the updated terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.
